AS JOIAS DAS ARÁBIAS E O GOVERNO BOLSONARISTA: CONSIDERAÇÕES SOBRE O PROCESSO ADMINISTRATIVO DE CONTROLE EXTERNO Nº 003.679/2023-3, JULGADO PELO TRIBUNAL DE CONTAS DA UNIÃO

Resumo

Com abordagem qualitativa documental-bibliográfica, estuda-se a Representação nº 003.679/2023-3, cujo assunto é “Apurar possível irregularidade na destinação dos presentes recebidos pelos integrantes da comitiva do presidente da República nas viagens oficiais à Arábia Saudita em outubro/2021 (joias) e aos Emirados Árabes Unidos em outubro/2019 (armas)”. O referido Presidente é Jair Messias Bolsonaro, que não declara e não entrega os bens à União, conforme noticiado pela imprensa. A mencionada Representação é julgada pelo Tribunal de Contas da União através do Acórdão 443/2023, proferido pelo Plenário na sessão de 15/03/2023. Comentam-se as normas ético-morais de obrigatório cumprimento pelos agentes públicos do alto escalão executivo federal, os princípios jurídicos constitucionais da Administração Pública e outras leis direta ou indiretamente relacionadas ao tema.

THE JEWELS OF THE ARABIAS AND THE BOLSONARIST GOVERNMENT: CONSIDERATIONS ON THE ADMINISTRATIVE PROCESS OF EXTERNAL CONTROL Nº 003.679/2023-3, JUDGED BY THE COURT OF AUDITORS OF THE UNION

With a qualitative documentary-bibliographic approach, Complaint nº 003.679/2023-3 is studied, whose subject is “To investigate possible irregularities in the allocation of gifts received by members of the delegation of the President of the Republic on official trips to Saudi Arabia in october/2021 (jewelry) and the United Arab Emirates in october/2019 (weapons)”. The said President is Jair Messias Bolsonaro, who does not declare and does not deliver the goods to the Union, as reported by the press. The aforementioned Representation is judged by the Federal Court of Auditors through Judgment 443/2023, issued by the Plenary in the session of 03/15/2023. Comments are made on the ethical-moral norms that must be complied with by public agents of the highest federal executive level, the constitutional legal principles of Public Administration and other laws directly or indirectly related to the subject.
